Couple convicted - forged Grant Deeds to sell property

In the following press release Stanislaus County District Attorney Birgit Fladager announced today that Jason Huber, age 38, and Angie Huber, age 37, both of Hickman, were convicted on September 30, 2008 following an 8-day jury trial involving Real Estate Fraud. Both defendants were found guilty on one count of Forgery and one count of Procurement of a False Document at a Public Office. Deputy District Attorney Marlisa Ferreira prosecuted the case for the People.
The case arose out of events which occurred on August 18, 2005 in the city of Modesto. The defendants forged the Grant Deed to property located at 801 Hickman Drive in Hickman which was owned at the time by Lester and Kathy Henslee, defendant Angie Huber’s parents. The defendants then passed the false Grant Deed to the Recorder’s office in Modesto to be recorded. The Henslees learned of the forgery and change in their title when they went to sell their property and were told by a Real Estate Agent they did not have title. When confronted by her parents, defendant Angie Huber ‘Quit Claimed’ her interest back to her parents but defendant Jason Huber refused to comply insisting it was a gift to him.
Insurance Agent and former Notary Dirk Vermeulen of Oakdale was charged in the original complaint but pled to a misdemeanor notarial violation for testimony against the Hubers at trial.
Sentencing for both defendants who are currently out on bail is scheduled for November 17, 2008 at 8:30 in Department 8. Both defendants face a maximum three years and eight months in state prison.
